ARA Studios reserves the rights to all photographs displayed on this website and other socil medias assiciated with ARA Studios.
FEES, DEPOSIT, & PAYMENT SCHEDULE
For the services of ARA Studios, a 30% non-refundable retainer is due upon the agreement date to reserve the Photographer’s time. The $50 consultation fee will be added to the retainer total. The booking is not confirmed until both this contract is signed and the retainer is received. The remaining balance is due before the release of media. Late payments may result in the forfeiture of the session date or a late fee of $5/day on outstanding balances. Payments are accepted via e-transfer to info.arastudios@gmail.com, online payments or Interac e-Transfer, or Credit Card, or cash (no change available).
2. CANCELLATION, RESCHEDULING, & CANCELLATION BY THE PHOTOGRAPHER
If the Client cancels the session or event, the retainer is strictly non-refundable. If cancellation occurs within 30 days of a wedding or major event, the Client remains liable for the full remaining balance. Request for rescheduling must be made in writing. Portrait or product sessions may be rescheduled once up to 48 hours before the session without penalty, subject to the Photographer’s availability. Weather-related postponements for outdoor sessions will be decided jointly at the Photographer's discretion. In the highly unlikely event that the Photographer is unable to perform their duties due to severe illness, injury, acts of God, or other emergencies beyond control, the Photographer will make every effort to secure a competent replacement photographer of equal skill. If a replacement cannot be found, all funds paid by the Client (including the retainer) will be refunded in full, and the Photographer shall have no further liability.
3. INTELLECTUAL PROPERTY & COPYRIGHT
In accordance with the Copyright Act of Canada, the copyright of all images created under this contract remains the sole and exclusive property of the Photographer.
Client Usage License:
Personal Use (Weddings/Portraits): The Client is granted a non-exclusive, perpetual, personal-use license to print, share, and display the final images. The Client shall not alter, edit, or resell the images for commercial profit. If the client does not wish to have photographs displayed on the photographer’s social media for advertising purposes, express written consent must be discussed with the photographer upon signing this contract.
Commercial Use (Product/Commercial): The Client is granted a commercial license to use the final images for marketing, website, and social media promotion. Sub-licensing or selling images to third parties is strictly prohibited without written consent.
4. MODEL RELEASE
The Client hereby grants the Photographer the irrevocable and unrestricted right to use the images captured during this session/event for the purpose of editorial, portfolio, website, social media, advertising, or exhibition display. If the Client requests a private gallery (images will not be shared publicly) the must indicate so within their contract.
5. IMAGE DELIVERY & EDITING STYLE
The Client acknowledges that they are familiar with the Photographer's portfolio and artistic style. The Photographer will use their professional judgment regarding lighting, posing, and post-processing editing. Requests for heavy digital manipulation (e.g., body shaping, extensive cloning, object removal) are not included and may incur additional fees. Final edited digital images will be delivered via a secure online gallery within: Portraits/Products: 2–3 weeks from the session date. Weddings: 6–8 weeks from the wedding date. RAW Files: The Photographer does not, under any circumstances, deliver unedited or RAW files to the Client.
6. LIMITATION OF LIABILITY & ARBITRATION
Technical Failure: The Photographer takes utmost care regarding professional equipment, backup systems, and digital storage. However, in the event of equipment malfunction, data corruption, or loss of images, the Photographer's liability is limited strictly to a refund of monies paid for that specific service or portion thereof. Governing Law: This Agreement shall be governed by, and construed in accordance with, the laws of the Province of Ontario, Canada. Any disputes arising from this contract will be handled within the jurisdiction of Ontario courts.
